While the SEC complaint is set forth in what appears to be in plain english, it is hard for me to understand the facts here and I am a trained securities lawyer! Good luck for the lay person to sought through the fact pattern. But, for sure, while things do not smell kosher here for any of the parties involved in putting this offering together, clearly, the once revered and feared SEC is clearly trying to regain some luster by taking on Goldman. Where was the oversight in 07 when this was taking place?
The SEC commissioner was probably setting up for his next gig as political ambitions remained high despite his ineptitude and seeming indifference to regulation. My guess is his retirement plan did not take a hit like some many others Americans.
While no doubt the attorneys at Big Law are salivating at the fees in defending the finest of the once mighty bulge bracket firms, unless there is some serious restitution of monies to those alleged to be defrauded investors (unlikely), this may be just a glamorous display of wasting more taxpayers money pursuing the fox already in the hen house.
Maybe it is better to use the money to be spent on this matter instead to find solutions to the financial system, as it is still clearly broken?? It will be interesting to see how this unfolds and whether anyone really gets punished for these actions. What's the betting line??
